Fraud State Statutes

Overview

The primary purpose of CMS’ Medicaid fraud state statutes site is to provide a means of sharing innovative and effective program integrity legislation.  We hope you find this information helpful in developing and proposing legislation appropriate for your state.

This site provides a comprehensive listing of official state statutory citations that are used to prosecute civil or criminal fraud, to maintain program integrity, and/or to combat program abuse.  It was constructed in a way to provide various searches by major topics and subtopics with official citations, or by state, then by topic.  Direct links to individual state legislation sites, LEXIS-NEXIS and Westlaw are provided to retrieve the actual text of the citations. (For Citations, click on the link below.)

For links to State Web sites containing legislative information, click on the link below.  For information on principal State Contacts (State Medicaid Directors, program integrity contacts, Medicaid Fraud Control Unit contacts), click on the link below.

Model managed care statutes, which can be used as a framework for states in developing or for customizing their own state statutes, can be found on the left navigation bar.

CMS wishes to thank all states for their active participation and for providing the necessary data to support this endeavor.
